PROCEDURE FOR CHANGING THE ELECTRICITY SUPPLIER
Each of our Clients has the right to change the supplier at any time by concluding a new Electricity Supply Agreement with another energy supply company.
The change of electricity supplier takes place in accordance with the requirements of Section VI of the Rules of the retail electricity market, which were approved by the Resolution of the National Commission for Electricity Market Regulation № 312 of March 14, 2018 ( https://zakon.rada.gov.ua/laws/show/v0312874-18 , hereinafter - Rules *), in accordance with the following procedure.
The consumer has the right in the order established by these Rules to change the electricity supplier by concluding a new contract for the supply of electricity to the consumer (supply of electricity by the universal service provider) with the new electricity supplier.
The process of change of electricity supplier is provided by entities (participants) of the electricity market and participants of the retail electricity market, which are involved in the process of change of electricity supplier and provide change and information exchange during such change on a free basis.
The change of electricity supplier at the initiative of the consumer must be completed within a period beginning from the date of notification by the consumer of a new electricity supplier of intentions to change the previous electricity supplier, but within a period not exceeding 21 calendar days from the date of notice.
The day of notification by the consumer of the intention to change the electricity supplier is considered to be the date of the recorded appeal of the consumer to the new electricity supplier regarding the intention to enter into an agreement with him on the supply of electricity to the consumer.
If the consumer has a valid contract for the supply of electricity to the consumer with a fixed term (term), in order to avoid penalties for early termination of the contract by the previous supplier, the consumer must notify the new supplier of his intention to enter into a contract for electricity supply for 21 calendar day before the expiration date (term) of the current agreement.
Within one procedure of change of the electric supplier by the consumer according to the order defined by this section change of only one electric supplier is possible. In this case, the consumer can initiate several procedures to change the electricity supplier at the same time.
Notice of intention to enter into a new contract with a new electricity supplier is provided in the form of a statement of accession to the contract for electricity supply to the consumer on the terms of the published commercial offer of the electricity supplier, and if the parties about the intention to conclude a new contract with a new electricity supplier, the consumer must provide the new electricity supplier with the following information:
personal data (surname, name, patronymic) of the consumer or authorized person or the name of the company (for a legal entity), as well as for legal entities and natural persons-entrepreneurs: an extract from the USR, printed from the Internet, or a copy of the certificate, or a copy of the extract from the USR; for individuals: a copy of the certificate of assignment of identification number or registration number of the taxpayer's card or passport number and series (for individuals who due to their religious or other beliefs refuse to accept the identification number, officially notified by the relevant authorities and have a mark in the passport);
contact details (phone number, e-mail, postal address for correspondence, etc.);
EIS-code (s) of electricity metering point by object (objects) of the consumer;
name of the current electricity supplier;
other data provided by the application-joining to the contract on supply of electricity to the consumer according to these Rules (if the consumer has chosen the certain commercial offer of the new electric supplier), other documents which can be required according to the chosen commercial offer;
consent to the processing of personal data and their use to obtain information about the consumer from the administrator of commercial accounting.
The date of commencement of the procedure for changing the electricity supplier is the date of receipt of all necessary data provided for in paragraph 6.1.5 of Chapter 6 of the Rules.
In case of incomplete data, the electricity supplier must notify the consumer. After receiving all the necessary data, the electricity supplier must provide the consumer during the day with confirmation of the start of the procedure for changing the electricity supplier and concluding a contract with him for the supply of electricity to the consumer.
The new electricity supplier must within three working days send a request to the administrator of commercial accounting to change the electricity supplier, which must include:
consumer information specified in paragraph 6.1.5 of Chapter 6 of the Rules;
the planned start date of electricity supply by the new electricity supplier;
EIS code of the electricity supplier.
After receiving and verifying the request to change the electricity supplier, the commercial accounting administrator must send a request to the consumer's commercial accounting service provider for a control data withdrawal within the next day, which must contain:
EIS-code of the metering point by object (measurement site);
the planned start date of electricity supply by the new electricity supplier.
The administrator of commercial accounting no later than the next day from the date of receipt of the request to change the electricity supplier must generate forecast consumption volumes at the point of accounting for the planned date of change of electricity supplier and:
check information about the consumer and his object (objects);
to notify the new electricity supplier about the possibility (absence of possibility) of changing the electricity supplier;
notify the previous electricity supplier of the consumer about the receipt of a request to change the electricity supplier, the date of the planned change of electricity supplier and forecast
The provider of commercial accounting services within 5 calendar days after receiving a request from the administrator of commercial accounting must:
to generate forecast data on the readings of the means (means) of measuring equipment (means of commercial accounting) on the date of change of the electricity supplier and to inform them to the participants of the retail market involved in the change of the electricity supplier;
to plan the removal of the actual readings of the means (means) of measuring equipment (means of commercial accounting) on the date of change of the electricity supplier.
In case of confirmation of the possibility of changing the electricity supplier, the messages of the administrator of commercial accounting must contain:
to a new electricity supplier:
confirmation of the date of change of the electricity supplier;
information on the history of electricity consumption by the consumer for the past periods;
to the previous electricity supplier:
notification of a change of electricity supplier and the date of such change;
to the system operator:
notification of a change of electricity supplier and the date of such change;
forecast volumes of electricity consumption at the point of metering on the planned date of change and forecast of the volume of electricity distribution for the next billing period.
If there is no possibility to change the electricity supplier, the commercial accounting administrator shall notify the new electricity supplier, indicating the reason for refusal to ensure the change of electricity supplier, which is the basis for stopping (canceling) the procedure for changing the electricity supplier.
The administrator of commercial accounting may refuse to ensure a change of electricity supplier in the following cases:
lack of technical feasibility (inconsistency of the means of commercial electricity metering, operating modes, reliability categories, volumes of electricity consumption to the selected commercial offer of the electricity supplier);
the consumer does not have a valid consumer agreement on the provision of services for the distribution (transmission) of electricity with the relevant system operator;
termination of power supply of the object (objects) of the consumer at the request of the current electricity supplier or availability on the date of initiation by the consumer of the procedure of change of the electricity supplier of such request sent in accordance with the established procedure.
In case of receiving a notification from the administrator of commercial accounting about the impossibility of changing the electricity supplier, the new electricity supplier must notify the consumer within one working day after receiving such notification with the provision of appropriate justification and recommendations to the consumer.
The previous electricity supplier, after receiving from the administrator of commercial accounting a notice of change of electricity supplier must take all necessary measures to terminate the contract for the supply of electricity to the consumer with the consumer on the scheduled date of change of electricity supplier.
Until the termination of the contract for the supply of electricity to the consumer, the previous electricity supplier is obliged to ensure the supply of electricity under the terms of the current contract.
The previous electricity supplier must issue an electricity bill to the consumer no later than 5 calendar days before the expiration of the electricity supply contract, formed on the basis of commercial accounting data provided by the commercial accounting administrator.
The absence of payment by the consumer of the invoices issued on the date of the change of the electricity supplier and / or the presence of a dispute between the consumer and the previous electricity supplier is not a ground for stopping (canceling) the procedure of changing the electricity supplier.
5 working days before the date of change of electricity supplier, the commercial accounting administrator shall notify the settlement administrator of the need to change entries in the register of commercial metering points of the electricity supplier for new and previous electricity suppliers in the manner prescribed by these Rules.
On a certain date of change of the electricity supplier, the commercial accounting service provider in the presence of the consumer and / or system operator must take actual readings of the measuring instrument (s) or ensure their reading by the automated commercial accounting system.
The commercial accounting service provider must provide the commercial accounting administrator with the actual commercial accounting data at the time of the change of electricity supplier. Within one working day after the change of electricity supplier, the commercial accounting administrator sends the received actual data to the previous and new electricity suppliers.
These data are the basis for corrective settlements between the consumer and the previous electricity supplier and the initial data for the settlements of the consumer with the new electricity supplier.
If the actual data of commercial accounting exceed the forecast, the consumer must within 5 working days from the date of receipt of the final bill to make payments in favor of the previous electricity supplier.
If the consumer overpaid according to the forecast consumption data, the previous electricity supplier must return the excess funds to the consumer within 5 working days.
These payments must be made by the parties within 10 working days after the change of electricity supplier.
If no later than 3 calendar days before the date of change of electricity supplier, the consumer and / or new electricity supplier (except in cases of concluding a contract by joining the consumer in a public commercial offer) wishes to stop the change of electricity supplier, the new electricity supplier must immediately notify the commercial accounting administrator. Such a request is the basis for the refusal of the administrator of commercial accounting to ensure a change of electricity supplier.
At the request of the consumer, the new electricity supplier must inform him of the stages of the procedure for changing the electricity supplier. The date of change of the electricity supplier is considered to be the date of change of entries in the registers of consumer groups of electricity suppliers.
The consumer has the right within 14 calendar days after the change of electricity supplier to initiate the procedure of transfer to another electricity supplier without paying penalties for early termination of the contract.
Cancellation of the procedure for changing the electricity supplier is provided by the system operator by notifying the settlement administrator of the need to change the entries in the register of points of commercial accounting of the electricity supplier in the manner prescribed by the Market Rules.
Entities (participants) of the electricity market and participants of the retail market, which are involved in the process of changing the electricity supplier, are liable for damages to other entities and consumers in the prescribed manner.
