RIGHTS AND OBLIGATIONS OF THE NATURAL GAS SUPPLIER
The natural gas supplier has the rights and obligations stipulated by the Civil Code of Ukraine of January 16, 2003 № 435-15, the Commercial Code of Ukraine № 436-15 of January 16, 2003, the Law of Ukraine “On the Natural Gas Market” №329 from 09.04.2015, Resolution of the NCRECP № 2493 from 30.09.2015 "On approval of the code of the gas transmission system of Ukraine", Resolution of the NCRECP №2494 from 30.09.2015 "On approval of the code of gas distribution systems of Ukraine", Resolution of the NCRECP № 2496 from 30.09. 2015 "On approval of the Rules for the supply of natural gas" (hereinafter - the "Rules for supply") by other applicable regulations and the terms of the supply contract, in particular, but not limited to:
1. The supplier provides the consumer (buyer) with the necessary confirmed amount of natural gas for the period specified in the contract, under the conditions of fulfillment by the consumer (buyer) of its contractual obligations and the requirements of the current legislation of Ukraine.
2. The Supplier shall indemnify the consumer (buyer) for untimely or incomplete coordination with the GTS Operator of the confirmed volume of natural gas for the needs of the consumer (buyer) provided that the consumer complies with the natural gas supply contract in accordance with section VI of these Rules for the supply of natural gas.
3. The supplier has the right to quickly control the volume of natural gas consumption by the consumer (buyer), using the database of the GTS Operator or information of the consumer (buyer), as well as by independent control of natural gas consumption at the consumer's (buyer's) facility.
4. The consumer (buyer) and his supplier have the right to adjust during the settlement period the confirmed volumes of natural gas in the manner prescribed Code of the gas transmission system (Resolution of the National Commission for Regulation of Economic Competition № 2493 of September 30, 2015)
5. The supplier has the right to initiate / take measures to terminate or limit in the prescribed manner the supply of natural gas to the consumer (buyer) in the case of:
5.1. carrying out by the consumer (buyer) of incomplete or untimely calculations under the contract;
5.2. overspending of the daily norm (the schedule of uneven supply of natural gas agreed by the contract) and / or the monthly confirmed volume of natural gas;
5.3. termination of the natural gas supply contract;
5.4. refusal to sign the act of acceptance-transfer without the corresponding written substantiation;
5.5. occurrence of measures provided by the Rules on security of natural gas supply, acting in accordance with the requirements Article 5 Law of Ukraine "On the natural gas market" and apply to consumers who are not protected in accordance with these Rules.
5.6. Gas supply to the consumer may be interrupted (limited) in other cases provided Law of Ukraine "On the natural gas market", Code of the gas transmission system , Code of gas distribution systems, Safety rules of gas supply systems .
5.7. The Supplier has the right to take measures to limit or terminate the gas supply to the consumer through the involvement of the GDN / GTS Operator in these works.
6. The SUPPLIER ALSO HAS THE RIGHT TO:
6.1. enter into a natural gas supply agreement with any consumer and in the absence of overdue debts of the consumer for natural gas to the existing supplier to supply natural gas to the consumer in the period following the period of natural gas supply by the current supplier;
6.2. receive timely payment from the consumer for natural gas in accordance with the terms of the contract;
6.3. for unimpeded access (upon presentation of an official certificate) to commercial natural gas metering units installed at the consumer's gas consumption facilities, for verification of actual natural gas consumption data;
6.4. complete and reliable information from the consumer with whom the contract has been concluded on the regimes of natural gas consumption;
6.5. to initiate the procedure of termination (restriction) of natural gas supply to the consumer in accordance with the terms of the natural gas supply contract and in accordance with the requirements of the Supply Rules.
6.6. other rights provided by these Rules and current legislation and the terms of the contract.
7. THE SUPPLIER IS ALSO OBLIGATED:
7.1. comply with the requirements of the Rules of supply and the concluded contract;
7.2. to ensure the supply of natural gas on the terms and in the amounts specified in the contract for the supply of natural gas, provided that the consumer (buyer) complies with the discipline of natural gas selection and payments for it;
7.3. ensure the submission of all necessary documents for confirmation by the GTS Operator of the required amount of natural gas to the consumer (buyer), provided that the consumer (buyer) has fulfilled its obligations to the supplier to order the required amount of natural gas to the consumer (buyer);
7.4. in accordance with the established procedure to consider inquiries of consumers (buyers) concerning the activity connected with supply of natural gas;
7.5. timely provide the consumer (buyer) with reliable information, including the provided Law of Ukraine "On the peculiarities of access to information in the areas of electricity supply, natural gas, heat supply, centralized hot water supply, centralized drinking water supply and drainage", as well as data on actual charges (volume and cost) for gas supply services to enable consumers ( buyer) to regulate their own consumption of natural gas. No additional costs for providing information by the consumer (buyer) are paid;
7.6. promptly notify the consumer (buyer) if the supplier is in the process of liquidation or bankruptcy, or the supplier is under the procedure of suspension / revocation of the license for the supply of natural gas, or its license for the supply of natural gas is revoked or suspended and lack of natural gas resources;
7.7. adhere to the standards and requirements for the quality of service to consumers (buyers) of natural gas;
7.8. offer the consumer (buyer) under the contract of supply (sale) of natural gas a choice of payment methods for natural gas supplied and consumed, including bank payment service, online transfer, postal transfer, cash to the supplier's account at the box office and / or other methods, the agreement of which is fair, transparent and non-discriminatory between consumers (buyers).
7.9. create contact points to provide information to consumers (buyers). The contact details and mode of operation of each contact point are communicated by the supplier to the consumer (buyer) in the natural gas supply contract and on the supplier's website on the Internet;
7.10. Provide the consumer (buyer) with the final invoice after the change of supplier or termination of the natural gas supply contract no later than six weeks after such change or termination of the contract;
7.11. perform other duties provided by the Rules of supply, the provisions of current legislation of Ukraine and the terms of the contract for the supply of natural gas.
